Terms & Conditions
These Terms and Conditions shall apply to the sale of the Goods by the Seller (Etoile Bakery Ltd) to the Buyer (the person or company purchasing the goods) to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Etoile Bakery you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted on this website from time to time.
Please give as much notice as possible – for wedding orders this is usually at least 3-6 months before the wedding date, for novelty cakes two weeks before the party date. If we have space in our schedule we may be able to take orders at shorter notice than this, but that will be dependent on kitchen availability.
Rush orders are cakes ordered within one week of the date the items are to be delivered. Fees for rush orders may apply.
The images on the website are examples of our cakes. All our products are hand made and therefore each cake is unique and may vary from the website image. Due to the edible nature of our products, colours are approximate.
All our goods can be ordered in different sizes from those shown on the website.
Tiered cakes are constructed using plastic dowels, our sugar models and flowers use cocktail sticks and wires for support. We accept no responsibility for any issues that may occur due to inedible items being left in the cake.
Allergies and Dietary Requirements
Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, however, our products may not be suitable for those with certain allergies as our kitchen does handle wheat and nuts. As such we cannot guarantee that our produce will be free from allergen traces.
Payment is in advance – please pay at least a week before the goods are due to be ready.
For wedding cakes a £200 deposit is payable to confirm your date in our diary.
Final Balance Payments
For wedding cakes the final balance is payable 2 months before the wedding date. At this point we do not accept further changes to the cake design. Wedding cakes ordered with less than two month’s notice must be paid in full.
For novelty cakes, the full balance is payable at least one week before the event.
Deposits are non-refundable and non-transferable. Full payment is required if the order is cancelled within 7 days of the celebration date or within 60 days for a wedding cake. All cancellations need to be submitted in writing. On receipt of the cancellation, you will be sent a confirmation response with information regarding any money due from you or any money owed to you. If you owe us money, you must pay within 7 days of the date of the confirmation letter. Any unpaid balances will be pursued through the small claims court and customers will be responsible for costs and expenses incurred in this process.
A time will be agreed with you three days prior to the collection date, please ensure you are punctual as we cannot guarantee to be available if you do not arrive at the time agreed.
If you collect your cake we cannot accept responsibility for the cake once it has left our premises. It is best to travel with the cake in the boot of your car and to drive slowly and carefully.
Do not leave your cake in a warm car. If you place it in the footwell, please ensure the heating in the car is off.
Please ensure your cake is flat – if it is on a seat or on somebody’s lap it is unlikely to be flat and may get damaged
We will agree a time window with you for the delivery to take place. Please ensure someone is at the address given to accept the cake. If there is no one there, the cake will be returned to us and a second delivery charge will be applicable in order for it to be redelivered.
It is your responsibility to ensure the correct address is given otherwise an additional charge will be levied to cover the extra delivery costs.
Buttercream cakes can melt in warm temperatures so please store in the fridge until it is needed.
Sugar paste cakes should be stored at cool room temperature away from sunny windows and radiators. If the room is humid, air bubbles may appear, so please ensure the room is no damp.
In the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage to us within 48 hours and send photographic evidence of the damage within 7 working days if you wish to claim a refund or replacement. The Seller will not take back any undamaged goods from the Buyer unless agreed in writing by the Seller. The Seller accepts no liability for cakes that are damaged after they have been delivered to the agreed location.
If the cake is being collected, we do not accept any responsibility for damages incurred while transporting the cake to the venue. This in no way affects your statutory rights.
If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 6 weeks before completion may be subject to a surcharge. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.
Consultations are by appointment only and are not applicable to all orders. An appointment for a consultation and tasting must be agreed on with Etoile Bakery by email and a consultation fee must be paid prior to consultation date before it can be confirmed. All appointments for consultations will be confirmed in writing.
All price quotations, written or verbal, are valid for 30 days from the date of quotation.
Due to the personlisation of the design, bespoke and customised cakes are non refundable.
Return of Hired Equipment
We offer cake stand hire. A hire fee plus a security deposit is required in advance. We have a selection of stands and will provide the stand best suited to the cake. It is the Buyer’s responsibility to return the cake stand/s after hire to our Studio address within 3 days (on a working day). The deposit will not be refunded in the event that the stand/s is/are damaged, or returned after 3 days. We are not liable for any damages that occur to the cake stand before we receive it back. Once the stand is returned within the given timeframe and we are satisfied that it is not damaged we will issue a refund to the Buyer.
